Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Voice Writer mobile application ("App") developed by WELLPEACH ("Developer", "we", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Definitions

1. "App" means the Voice Writer application available on the Apple App Store and Google Play Store.
2. "User" means any individual who downloads or uses the App.
3. "Content" means all notes, text, checklists, and any other data created by users within the App.
4. "Premium" means the paid subscription or lifetime purchase plan that unlocks advanced features and removes advertising.
5. "Free Tier" means the basic, no-cost version of the App with limited folders and notes, supported by advertising.

3. License to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your personal device solely for your own private note-taking purposes, subject to these Terms. This license does not include the right to:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Create derivative works based on the App
• Remove copyright or trademark notices

4. Free Tier & Advertising

1. The free tier of the App is supported by advertising provided by Google AdMob.
2. Ads are displayed periodically during use (e.g., after opening notes).
3. On iOS, you will be asked for App Tracking Transparency (ATT) consent before personalized ads are shown. You may decline without losing access to the App.
4. Free tier users are subject to folder and notes-per-folder limits, which are displayed within the App.

5. Premium Subscription & Lifetime Purchase

1. Plans available: Monthly subscription, yearly subscription, and a one-time lifetime purchase. Prices are shown in the App and may vary by region.
2. "Lifetime" defined: A "lifetime" purchase grants premium access for as long as the App remains available and operational. It does not guarantee that the App will exist indefinitely, nor does it constitute a perpetual service contract. We make no warranty that the App will be available for any specific duration.
3. Payment: All purchases are processed by Apple (App Store) or Google (Google Play) via in-app purchase. We do not handle payment data directly.
4. Auto-renewal: Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. The renewal charge is confirmed 24 hours before the period ends.
5. How to cancel:
   1. iOS: Settings > [Your Name] > Subscriptions > Voice Writer > Cancel Subscription
   2. Android: Google Play > Menu > Subscriptions > Voice Writer > Cancel
6. Cancellation effect: Cancelling your subscription does not remove access immediately — you retain premium access until the end of the paid period.
7. Lifetime purchase: A one-time payment that provides permanent premium access on the purchasing device. Not transferable between accounts.
8. Restore purchases: Use the "Restore Purchases" button in the App's subscription screen to restore any prior purchase on a new device or after reinstalling.

6. Refunds

1. All purchases are subject to the refund policies of Apple (App Store) or Google (Google Play).
2. Refund requests must be submitted directly to the respective platform:
   1. iOS: reportaproblem.apple.com
   2. Android: Google Play support
3. We do not have authority to issue refunds for purchases processed through these platforms.
4. If the App is unavailable due to our error, we will extend your subscription period by the equivalent duration or provide comparable compensation.

7. User Content

1. All notes and content you create in the App are stored locally on your device. We do not access, read, or process your note content.
2. You are solely responsible for the content you create and store. Do not use the App to store content that is illegal in your jurisdiction.
3. You are responsible for maintaining backups of your data. We are not liable for data loss resulting from device failure, App deletion, or other causes.

8. Intellectual Property

1. The App, including its design, code, graphics, and branding, is owned by WELLPEACH and protected by copyright law.
2. The name "Voice Writer" and associated icons are trademarks of WELLPEACH.
3. User-created note content belongs entirely to the user. We claim no rights over any content you create in the App.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to exploit, hack, or disrupt the App or its infrastructure
• Circumvent or tamper with subscription verification or licensing mechanisms
• Share premium account access with others (premium is per-device/per-account)
• Use automated tools to interact with the App

10. Service Changes & Termination

1. We reserve the right to modify, suspend, or discontinue any part of the App — including removing it from app stores — at any time, for any reason, without prior notice.
2. If the App is removed from the App Store or Google Play, existing installs on your device will continue to function, but updates will no longer be available. We are not obligated to maintain the App in any store indefinitely.
3. All purchases (subscriptions and lifetime) are processed by Apple or Google. Refund eligibility upon discontinuation is governed solely by the refund policies of those platforms. We do not directly issue refunds. Users who wish to request a refund must contact Apple or Google directly.
4. We may update the App (including features, pricing, and limits) without prior notice. Significant changes will be communicated via in-app notices or this page.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WELLPEACH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Changes to Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes will be communicated via an in-app notice. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If negotiation fails, the dispute may be submitted to binding arbitration or a court of competent jurisdiction.
